Township Clerks Office


   The Township Clerks serves as the Secretary to theĀ  Governing Body and is Responsible for storing and maintaining Government Records, such as all minutes, ordinances, resolutions, contracts and other Government Records that have been made during the course of a business day.

  The Clerk is also the registrar of Vital Statistic. The Registrar is responsible for all Vital Statistic like marriage licenses, civil unions and can issue copies of death, birth, and marriages.

Marriage License/

To apply for a marriage License the Bride, Groom, and at least one witness need to be present at time of application.

All persons need to show identification

The Bride and Groom need to show proof of Divorce if previously married.

At least one of the two (Bride or Groom) must reside in town.

The cost for the application process is $28.00.

The Application Process takes 72 hours to be ready for pick up. The application can be held for up to six months.

From the date that the application is picked up it is good for 30 days.

Yes our Mayor performs marriages! If you would like to be married by our mayor be sure to ask for details when you come in. Please note she does need to be scheduled.

Is available to same-sex couples and unmarried couples over the age of 62.

A fee of $28.00 is due at the time of Application.

1) They must have a common residence and be "otherwise jointly responsible for each other's common welfare." Id. This latter requirement can be satisfied by demonstrating that the couple has a jointly-held mortgage or joint real or rental property; a joint bank account; a will, life insurance policy or retirement plan designating the other as a primary beneficiary; or a jointly owned automobile;

2) They must agree to be "jointly responsible for each other's basic living expenses" (defined as "the cost of basic food and shelter, and any other cost, including, but not limited to, the cost of health care, if some or all of the cost is paid as a benefit because a person is another person's domestic partner." N.J.S.A. 26:8A-3.);

3) Neither may be in a marriage or another domestic partnership;

4) They may not be related to each other up to and including the fourth (4th) degree of consanguinity;

5) The must be of the same sex, or both must be 62 years of age or over;

6) They must "have chosen to share each other's lives in a committed relationship of mutual caring;"

7) They must each be at least 18 years of age;

8) They must file jointly an Affidavit of Domestic Partnership; and

9) Neither may have been a partner in a domestic partnership terminated less than 180 days prior to filing the Affidavit (unless one of the partners had died) and, if previously registered as a domestic partnership, the prior partnership must have been terminated in accordance with the Act.

Dog/Cat Licenses

As required by State Law and Municipal Ordinance you must license your dog/cat by JANUARY 31ST.

Fees are as follows:
     Spayed/Neutered Dog        $18.00
     Non Spayed/Neutered        $21.00
     All Cats                                  $18.00
     Late Fee                                $14.00

Late Fees will be in effect after January 31st

Be sure to look out for the Free Rabies Clinic Date.

Copies of Vital Statistics such as Marriage, Birth,Civil Union, Domestic Partnership, and Death Certificates can be purchased at the Clerks/Registrars Office.

If you are to apply for a Mercantile License

You will need to fill our our Mercantile License Application which can be found under our forms section or a link at the top of the page.

You will see in the packet Pages 1-2 will need to be delivered to the Clerk's Office with a check Payable to the "Township of Berlin" for the amount of $150.00

Page 3 will need to be delivered to the Clerk's Office with a check in the amount of $60.00 payable to the "Township of Berlin"

Pages 1,2,3 all need to be verified and signed off by Michael Laginestra before delivering to the Clerk's Office.

Page 4 can be delivered to the Clerks Office as well, with a check payable to "Fire District #1" in the amount corresponding to the form.

Pages 5 and 6 need to be filled out and delivered to the Police Station in person by the applicant, now located in the rear of our new Municipal Building. From there the applicant will receive instructions how to complete their requirements.

If approved through the police department your application will then be heard at the next Mayor and Council Meeting. If approved you will receive your Mercantile License in the mail which is to hung in the view of the public.

Your license will expire every year on September 30th. You will receive reminders and the proper forms for renewal in the mail prior to your expiration. They can also be filed at the Clerk's Office. The renewal fee is $100.00 made payable to the "Township of Berlin". As well as renewing the Fire department form with a check made payable to "Fire District #1".

After September 30th there will be a late fee assessed of $50.00.

If no payment is received you could be subjected to closure of your business.

Business Registration

Page 4 will need to be delivered to the Clerk's Office with a check in the amount of $60.00 payable to the "Township of Berlin"

Yard Sale Permit

A yard sale permit application can be obtained from our form section or the top of this page.

The cost of a permit is $10.00 and needs to be obtained before the yard sale.

Please bring application and check made payable to the "Township of Berlin", cash or Money Order to the Clerk's Office for validation.
